Dear Expert,
Is it necessary that for registration of charge property should be in the name of company? If the property is in the name of director of the company, in that case also registration of charge is required or not?
Please reply ASAP alongwith relevant provisions etc.

| Dear Puneet, As per Section 125 of the Indian Companies Act, 1956 which will no longer be in existence, It is necessary that for registration of charge, property should be in the name of the company, otherwise it would be void...... Hope this will make you reach over your query....
