please suggest me opinion and case laws specially of Rajasthan High Court or Rajasthan Tribunal regarding client's past history should be taken into account while determining gross profit against comparable cases. My client history is just two years old including the year under scrutiny. |

| Dear Shiv,
It appears that the query pertains to transfer pricing under income Tax. If yes, I would request you to further elaborate the same i.e. as such what are grounds on which the issue demand/SCN regarding the same is issued as the same will help us in addressing the issue in the best possible way.

| No. Actually my client's case is under scrutiny under 143[3] of the Income Tax Act and ITO want to apply comparable cases to determine gross profit rate, we do not agree with this and insisting upon that first our past history should, gross profit past history,be applied.
