Hallo sir/madam
I am in BHEL employment. For FY 2011-12 first 6 month (April 11 to sep 11) I have posted at Bhopal (MP) at MP state govt. lived employment tax their for form my salary Rs. 1500/- has been deducted & deposited to state govt by my employer and at MP my employer has been allowed a deduction for calculation of net salary income.
Example: Gross Salary : 635220 – less employment tax Rs. 1500/- Net Income: 633720
From oct I have posted at haridwar (UK) where no such tax exist.
My query: whether such tax (employment tax rs. 1500/-) has deductable from my salary from computation of net taxable salary income for FY 2011-12.
If yes, which IT act sections allow it.

Dear Vinod,
Section 16(iii) of Income Tax Act, 1961 provides for deduction of any sum paid by the assessee on account of a tax on employment within the meaning of Article 276 (2) of the Constitution, leviable by or under any law. However, Article 176 (2) restricts the maximum amount of deduction upto Rs. 2,500.
Thus, in the instant case you can claim the deduction of Rs. 1,500 paid on account of employment tax to the Madhya Pradesh state government.
Hope the above suffice.
