Please Help: Income Tax Return in case of deceased assessee

I got a notice to file an ITR for my assessee but my assessee is no more, in such a case who will be able to sign his return? Do we get any exemption from filing the return, if yes what is the procedure??? |

Dear Surbhi there is no provision in Income Tax Act for exemption from filling ITR in case of deceased assessee. In this case you have to file the ITR of the deceased person as a legal heir/ representative assessee and in this case PAN of the legal heir will be used for verification of ITR.If there is a refund or total income is above 5 lacs then you have to file ITR on line otherwise you may file paper return. |

There is no exemption for that, you have to register as legal heir in your income tax login to follow the procedure mentioned their and file the income tax return.

In this case ITR will be signed by assessee's legal hair (LH) and you cant take exemption from filling the ITR. |
