Supreme Court Says 25-Year Experience Requirement for CAs in Tribunals Unconstitutional
The Supreme Court, while clarifying its earlier judgment in the Madras Bar Association case that struck down the Tribunal Reforms Act, 2021, held that Chartered Accountants are not required to possess a minimum of 25 years of experience to be eligible for appointment as Technical Members in tribunals such as the Income Tax Appellate Tribunal.
The clarification was issued by the Bench comprising Chief Justice of India B. R. Gavai and Justice K. Vinod Chandran, following a submission made by counsel representing the Institute of Chartered Accountants of India (ICAI). This clarification reaffirms the eligibility of qualified Chartered Accountants for technical positions in tribunals without the imposition of an extended experience threshold.
