A Kerala Court on Saturday (February )issued non-bailable warrants against Baba Ramdev and Acharya Balakrishna following their non-appearance in the criminal case filed by Kerala Drugs Inspector against Divya Pharmacy over alleged misleading medical ads.
The warrants have been issued to secure their presence on February 15. Earlier the Court (Judicial First Class Magistrate-II Palakkad ) had issued bailable warrants to the accused for their appearance on Feb 1. Since they did not appear on February 1, the Court has now issued non-bailable warrants.
The complaint is filed by the Drug Inspector under Section 3, 3 (b) and 3 (d) of The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954. Section 3 prohibits the advertisement of certain drugs for the treatment of certain diseases and disorders. Section 3 (b) prohibits advertisements of drugs claiming maintenance or improvement of the capacity of human beings for sexual pleasure. Section 3 (d) prohibits advertisements of drugs that claim the diagnosis, cure, mitigation, treatment or prevention of any disease, disorder or condition of diseases provided in the Rules made under the Act.
