Please Help: Excise & Service tax

Can a CO.,Say A ltd., issue excise invoice to a service provider (not registered in excise),using the goods to be purchased from A ltd. as capital goods for taking cenvat credit.

If the service provider is not registered under excise, the co. can not issue excise invoice and not possible to take cenvat credit.
