One of My Client running one Crusher Industry. he was Supply Labours to a Civil Contractor (Partnership Firm). The Total Monthly Bill is about 25.00 lacs. i want to know that whether he can liable to charge the service tax on bill or not. because the receiver of service is not ready to pay Service tax than who can liable to pay service tax. |

Dear Sunil,
The service provided by your client will be liable to service tax under the taxable head 'Manpower Recruitment service'. Further, even if the service receiver is not willing to pay service tax, your client have to pay service tax and the amount received i.e. 25 lakhs will be treated as cum service tax. [ Refer section 67 of Finance Act, 1994 read with Service Tax (Determination of Valuations) Rules, 2006]

Your client has to pay the service tax assuming the receiving amount as inclusive of service tax.
