Whether Father of karta (huf) Transfer his immovable property to huf without Registry charges (stamp duty) |

Hi, In my OPINION, property can be transferred in between the blood relation, without the requirement of transfer on registry. HUF is also a family arrangement, hence registration might not be required. However i request considering other opinions and legal supportings

If question of ownership arise then whiout registration it should not be possible otherwise there should not be any restriction for transfer of property to the extent of my knowledge.

but there exists a lot of cases where the hereditary property is never registered in the name of sons or grand sons..the only proof of movement is the shifting of property in the records of village numberdaar.. in those cases the successor is very well referefd as the owner without the requirement of a registery

For Ownership rights & for any purpose of mortgage, the registry in name of owner is a neccessity. However, the registration charges can be minimum in gift cases as there is no money payment between the parties. Registration in name of transferee is necessary. |
