ITR Records Gain Wider Importance After SC Ruling on Accident Compensation

The Supreme Court has held that Income Tax Returns (ITRs) can play an important role in assessing income for determining compensation in motor accident cases. The ruling highlights that ITRs are not only relevant for tax compliance, loans or financial verification, but may also serve as key evidence in legal and compensation-related matters.
The Court observed that a victim’s or claimant’s income must be assessed in a fair and consistent manner while calculating motor accident compensation. For salaried individuals, the latest ITR may generally reflect their annual income, as their earnings are usually stable and supported by documents such as Form 16, salary slips and tax records.
For self-employed individuals, professionals and business owners, the Court noted that income may fluctuate from year to year due to business conditions, market changes, seasonal income, profits or losses. Therefore, courts may consider the average income declared in the ITRs filed during the previous three years to arrive at a more realistic assessment of earning capacity.
