One of our client company is having a turnover of Rs. 160 Crores. The Company wishes to pay remuneration to the MD on export sales being acheived by him @8% this year. The remuneration is being paid to him only and not to other 6 directors. Rectification u/s 154(7) of TDS Demand u/s 272A(2)(K) - Hi..., I have checked there is manual demand created by AO on the traces Portal of Total Rs.3,33,300 for the For FY.2009-10, 2010-11 & 2012-13. While i visited to the ITO Nirman Vihar, Delhi, found clarification from the AO that It was created u/s 272A(2)(K) which for delay furnishing of TDS return. although i have filed those TDS statement within the time prescribed on due date. I have filed rectification u/s 154 dated January 30,2019, but AO is not considering my application stating that time(4 years) for rectification is expired. Now what recourse/ remedy is available to rectify those mistake which are apparent from the record of the tax authorities. Thanks Your valuable suggestion will be highly appreciable

Q. GST registration whether required on goods received at seaport - Dear Experts,

M/s. A having GST Kolkata registration is planning to purchase goods from M/s B of Mumbai, whose goods has arrived at Vizag Seaport. M/s A further wants to sale goods to M/s C of Orissa. The goods will be directly pickedup from Vizag Seaport by M/s C. Now in this scenario, please guide with the following : 1) As per my understanding importers who dispose there goods directly from Seaport are compulsorily liable to register in the state where goods are imported. Is my understanding right? 2) Section 10(1)(b) which is for "Bill to Ship to" is not applicable to imported goods, so whether this option is available or not ? 3) M/s B who purchases goods from M/s A and sells the same to M/s C and delivery will happen from vizag port to Orissa. Whether M/s B has to take casual registration in Vizag and do the business as goods are actually received by M/s B at Vizag Port and sold to other party by directly lifting goods from there. Your early response would be very helpful

How to claim interest expense on hosing loan of director in company in which he is director - One of the director having housing loan on his residential property of Rs.12crore & paying interest of around Rs 1crore P.A., since there is restriction in house property under income tax that interest expense can be claimed upto 2 lakh P.A. on owned property, so he want to claim interest on such loan in the company in which he is director without transferring the ownership of property to company is there any possibility that loan can be transferred without attracting tax liability.
