A pvt Ltd company after settleing all dues of Old TDS Demands found a number of unconsumed Challans (Partly) majorly for FY 2017-18. Now it intends to get refund of the same. Please advise in the matter.

If a Private Limited Company has unconsumed or partly consumed TDS challans (particularly for FY 2017–18) after settling all old TDS demands, it can claim a refund, but only through a specific process, since TDS challans do not automatically generate refunds.

? Step-by-Step Process to Claim Refund of Unconsumed TDS Challans
???? 1. Identify Unconsumed Challans Clearly
Use the Form 26AS and TRACES portal to:

Download Challan Status Inquiry (CSI file) and Challan details

Verify which challans were not mapped to deductee entries or were partially consumed

Export the Challan-wise consumption report from TRACES

???? 2. Justify Refund Eligibility
The company should confirm:

There is no further pending TDS liability for the FY

No intention to adjust these challans in future TDS returns

These challans are not disputed or under processing

As per CBDT Circular No. 2/2011 dated 27.04.2011, the deductor can claim refund of excess TDS deposited.

The Assessing Officer may verify your claim and raise clarifications.

If satisfied, AO will process the refund manually (not through TRACES or CPC).

Processing may take time and requires follow-up with the TDS ward.

?? Important Notes:
There is no online mechanism for refund of TDS challans currently.

You cannot claim it via ITR or CPC like a taxpayer refund.

Adjustment against future liability (carrying forward) is an alternative if refund is not viable.

For FY 2017-18, ensure that limitation or any time-barred issues (6 years for refund as per Sec 244A) are addressed.

Yes, a company can claim a refund of a partly unconsumed challan for earlier years, but the process is manual, and approval is subject to the discretion of the Assessing Officer (TDS). 1. Identify the Challan • Download Form 26AS and TDS statements from TRACES. • Match challan CIN with amount consumed and balance unutilized. • Ensure the balance is not tagged to any deductee PAN. 2. Draft a Refund Request Prepare a manual refund application to your Jurisdictional TDS Assessing Officer. Include: • Covering letter explaining: • The year of payment. • Reason for partial non-utilization. • Request for refund of the unutilized balance. • Copy of the original challan (CIN details). • Copy of the TDS return(s) showing how much of the challan is consumed. • Copy of bank statement showing actual payment. • Undertaking that: • Excess amount is not claimed or passed to deductees. • The company will not claim the amount again. • TAN & PAN of the deductor. • Any additional proof of reconciliation if asked by the AO. 3. Submit to AO • File the application physically or through e-mail as directed by the AO. • You can check your AO’s contact details via the Income Tax portal > Profile > Jurisdiction Details. 4. Follow-Up • AO may ask for more info or verification. • Once satisfied, AO forwards the refund recommendation to CPC for processing.
