Q. Legal heirs tax liability when no consideration - Assessee had transferred his property to someone else in 2006 and died in 2009, and his weif (legal heir) had no idea about the property and hence got nothing as consideration. Ito had opend the case in 148 and asked her to pay tax as his legal heir.
So qus. is this that wheather she is liable to tax even then she did not receive any consideration.

Change of proprietor - Mr. X is proprietor of a trading firm and Mr. Y is the manager of the whole business of the firm,X is just proprietor for filing of returns.Now Mr X has died but during his lifetime there was oral agreement between Mr.X and Mr.Y that after death of Mr.X Mr.Y will become the proprietor and all assets and liabilities of business will be transferred to Mr.Y and this fact is known to all the family members of Mr.X and they agree to it but there is nothing in written.Now What is the procedure for doing the same and are there any tax implications? Q. VAT - Plz Ans.
The dealer is registered under Delhi VAT and he is engaged in online trading like flipcart, jabong etc. His vendor is in Gujarat and if any customer, lets say from Maharashtra or Tamilnadu place any order online to him, he approach his vendor in Gujarat to directly deliver goods to his customer in their particular city. Now the points to be cleared are :
1. The goods were dispatched from Gujarat to Maharashtra/Tamil Nadu and in Delhi no activity was performed so how can we apply Delhi VAT on it.
2. How can we send invoice to the customer along with goods, as goods are being delivered from Gujarat but dealer is in Delhi.

Q. income tax - One of my client take unsecured loan Rs. 5.00 Lacs. from his Wife by account payee cheque. his wife was deposited cash in her account and issued a account payee cheque as U/L to her husband.she was also shown this amount to her income tax return. in the scrutiny case ITO disallowed this transaction and disallowed and added as income in my client account. i want to know that whether any circular of cbdt in this record or not. and whether the action taken by ITO is justified or not.

Q. income tax - One of My Client sold some plots which he was purchased as a agricultural land.he purchased that land in 2007 at Raigarh. Chhattisgarh state he sold his plots in different sizes just 20 days ago at Rs.5 lakhs each.he note this amount in document which is registered by registrar office,also his plots government value was noted in his document i.e.Rs.10 lakhs.
i want to know that whether advance tax for that transaction,when i calculated his advance tax against this transaction,i considered sale consideration value Rs.10 lakhs, but he actually received Rs.5 lakhs.here front party deposited stamp duty + registration fees on amount of Rs.10 lakhs.
BUT MY PROBLEM IS HOW whether we CALCULATE THE ADVANCE TAX FOR LONG TERM CAPITAL GAIN ON SALE CONSIDERATION ON AMOUNT Rs.10 LAKHS when he received 5 lakhs. because agriculture land is not covered under the defination of capital assets. or we considered rs. 5 lacs as consideration. pls inform. because it is the tax audit point.
