Q. > Please Help: EXEMPTED GOODS
Mr. Dev had puchase goods from manufacturer who charge excise duty on that. Aftr one month Mr. Dev acknowledged these goods are exempted and want to claim that money which is paid by him as a excise duty but manufacturer refused to pay. So, is there any provision through which Mr. Dev can claim that money. I am for expert reply

in case manufactures has wrongfully charged excise duty on the input supplied by him to you,and input was right fully passed on to you via proper invoice and other requirements, then you can claim the same and adjust it as input credit of excise duty against the excise duty payable by you

This should be ir respective of the fact that the goods were actually exempt of excise duty,, as the assesse has actully paid for the excise duty.

17-Oct-2012 , 03:45:27 pmThere is no provision to Claim that MOney from Manufacturer But If you have the Valid copy of Invoice that the manufacturer raised when you buy the product then on that base you can Claim the input credit from govt department. In case YOu Are the Consumer of that goods then there is no provision for claiming that Wrongly Charge Amount of Excise
