Q. > Please Help: Declaration form
Declaration form is used for avoid TDS? if the declarer resign from the job then what will do? Declaration form is the requirement of Income tax Depp or not?????
answered Jul 01, 2012 by Krishna Chandra Santi , Chennai
The above mentioned assessee is a salaried employee. So he may make an application in Form 13 to the Assessing Officer and if the assessing officer is satisfied that the total income of the recipient justifies the deduction of income tax at any lower rate or no deduction of income tax, he may give such certificate as may be appropriate. Such certificate is valid for
1) the assessment year specified in it,
2) the person responsible for paying salary,
3) until it is cancelled by the assessing officer.

Dear first of all i want to clear you that the Declaration form is not for avoiding TDS. It is for those person those have invested money in the exempted criteria of the IT Act. Now it is the liability of the person to file Income Tax return and submit the details in correct. Hence the declaration form is helpful tools for employee so that the TDS can be deducted as per the Income Tax Act guidelines.
