Q. > Please Help: DTAA
Dear Professional,
I deduct tds on payment to United Arab Emirates (Dubai) in professional income but United Arab Emirates not agree with tds and said that there are not any tax liability then how can i claim tds so not deducted tds on payment.
Can you suggest me it is possible as per DTAA provision or other lawa.

22-Feb-2012 , 10:44:21 pmDear Amit, As per my view,Dubai is a tax free country.This is the reason for disagreement.But to escape from consequences of failure to deduct tds on such income,tds should be deposited by payer in this situation as per section 195A OF IT ACT,1961.SO Dont go for DTAA Provision.
