Q. > Please Help: HRA Exemption
As per income tax Act, we have to submit PAN of landlord if the Annual Rent paid is more than Rs. 1,00,000/- to claim HRA exemption. But if during the year we stayed in two different houses and the rent paid to each landlord is not more than Rs. 1,00,000/- but in totality (i.e., during the F.Y.), the rent paid exceeds Rs. 1,00,000/-, then is there a need to submit PAN of landlord? And, if yes, then whose PAN is required i.e., of the First landlord or that of second one?

10-Feb-2016 , 09:55:09 amCIRCULAR NO. 8/2013, Dated: October 10, 2013 clearly states that if annual rent paid by the employee exceeds Rs 1,00,000 per annum, it is mandatory for the employee to report PAN of the landlord to the employer. Accordingly, no where it can be interpreted that the cieling of Rs. 1,00,000 is per landlord. The cieling is on the employee. Accordingly, in my opinion, PAN will have to be submitted of both the landlords. In case of no PAN, a declaration to that effect can be submitted.
