Q. > Please Help: tds
since, there is no liability for deduction of tds in case of transportation if they furnish pan no. is tds return is mandatory by deductor in above case? if yes what will be penelty for non filing of tds return in above case?

TDS Return is mandatory but the penalty amount will be "Zero"

03-May-2013 , 10:54:24 amYes TDS return is mandatory ,but penalty amount will be ZERO subject to that if he not deduct any tds & pan no. provided by trasporter. because as per section 234E (W.E. F 01 july 2012) penalty cannot exceed the amount of tds/tcs deductable or collectable as the case may be. and in this case tds deductable is 0 hence penalty will be ZERO.
