suppose I am an employee of the company i show my employer that i am eligible for 80C deduction and my employer did not deduct TDS than is it mandatory for my employer to give details of mine in tds return filed by him..
answered Nov 27, 2011 by Ashish Karundia , New Delhi
Dear Bharat,
Section 200 (3) of Income Tax Act, 1961 provides that any person being an employer referred to in section 192(1A) shall, after paying the tax deducted to the credit of the Central Government within the prescribed time, prepare a statement in 24Q for such period as may be prescribed and deliver or cause to be delivered to the prescribed income-tax authority or the person authorized by such authority such statement in form 24Q.
Further, Annexure II of Form 24Q states that the employer shall furnish 'Details of salary paid/credited during the relevant financial Year and net tax payable'.
Thus, in the light of the above it can be said that the employer is required to furnish the employee details even if no TDS is deducted.
I trust the above answers your query.
