i have a query regarding service tax , we are service receiver of watch and guard services, but service provider is providing invoice inclucive service tax full amount and we are paying the full invoice amount to provider, now my question is that whether we are also liable for paying service tax or not?

19-Feb-2015 , 03:31:28 pmYes you are liable to pay Service Tax on the Services received of watch and guard services(assuming your Service Provider is not company). Your Service provider can charge and collect the service tax @ 3.09%(25%) only and balance i.e 9.27%(75%) needs to be paid by you. If your service provider is charging full Service tax i.e. 12.36% then ask him to change the invoice accordingly.
