If the company charges Maintenance Charges from the flat owners for the upkeep of common area and common facilities like lift, water pump, etc. will the company required to charge, collect and pay service tax on such charges. Is there any exemption available if such charges are charged by the Resident Welfare Association

No. 28(c) of Notification No. 25/2012-ST, dt. 20.6.2012, service by an RWA's registered under any law for the time being in force, to its own members by way of reimbursement of charges or share of contribution, up to an amount of Rs. 5,000 per month per member, for sourcing of services from a third person for the common use of its members in a housing society or a residential complex is exempt from service tax.
