Q. > Please Help: Service Tax
If the Servic provider (MANPOWER SUPPLY)is sole proprietor and the service receipient is also sole proprietor, in such case what would be the liability of the service provider and service receiver under reverse mechanism ?

in the current scenario, as per my understanding I don't think reverse charge mechanism would be attracted because the service receiver is not a business entity and hence the normal service tax provisions would apply.

24-Dec-2012 , 01:06:13 pmThe Service of Manpower Supply would fall in Reverse Charge. if following two conditions are satisfied. 1. Service Receiver is business entity registered as a body corporate,and 2. service provider is any one of the following entities:- (A) Individual (B) HUF (C) Firm (Including LLP) (D) AOP In ur case the First Condition is not satisfied.as u are individual. So Service Tax would be Payable as Normal Provisions.
