Q. > Please Help: Service Tax
Assessee total receipt was 6 Lacs but he inadvertently charged service tax from one of party. Is he liable to charge service tax on all invoices thereafter or he can further take the benefit of exemption available to a Small Scale Service Provider upto Rs. 10 Lacs of receipts?

03-May-2013 , 09:59:00 amNO, he can not avail the benefit of SSP exemption against remaining services , because as per notification 6/2005 if any service provider once start paying service tax then he can not go back for same fiscal. so therefore in my professional view the SP shall be liable to pay service tax in respect to all rendering services.

07-May-2013 , 02:44:48 pmNO, as per SSP Exemption notification once you opt not to avail the exemption then for the whole year he has to comply with it. I think the assessee should return the amount of service tax collected and revise the bill otherwise he has to collect service tax on all the bills.
