Q. SHIS Scheme - Please tell me What is SHIS Scheme. Our one of the customer is purchasing the capital good from us where in he is asking to clear the same against SHIS scheme and without paying to excise duty. The customer is also referring the Notification No.33/2012-C.E. dated 09.07.2012 giving detailed procedure in this regard by condition No 2 (g) to (i) Which after reading i am not getting cleared about process. Please i request to the experts to guide me for the process of the same?

Q. Excise and Form H Sales - Hello Friends, I am struck at one thing
plz help
If there is a Customer who is Purchasing goods From us Under Form "H", then should i charge excise duty in that invoice or not ??
AS far as i know if customer is issuing form H then it means he is a direct exporter so there should be no Excise be charged from that Customer by Us ( Principal Manufacturer ), also no CST be charged as it is sales against form H
But the Problem is that the Customer has issued a Purchase order indicating Excise duty also , so shud i charge excise duty or not???

Q. job work - There is a provision in excise that if we get the job work done outside we have to pay duty,now if i hv enough space in factory and hire job worker then i can say myself from duty..but final product is liable to duty as per central excise provisions,now again if job worker condition is whatever is scrap is my profit and rest is yours, and 90% scrap which job worker wants as profit is the only profit of us also...and neither of us wants to pay any duty so are there any alternate strategies i.e. tax planning to save us from duty

Q. CVD - We are the manufacturing of agricultural products like harvester and tractor and we are imported the parts of these agricultural products from outside india and sold the final products in india or outside india.

Sir, i want to know that in india parts purchased for tractor and harvester are liable to excise duty and final product is exempt from excise duty.

In case of imported parts whether CVD ( equal to excise duty in india) levied or not or credit of Additional duties of excise will be available or not.

Q. pracial dificulty - pls help to solve my case..as per ccr 2004 exporters are allowed refund of cenvat credit when goods cleared under bond or letter of undertaking..but for that seperate accounts have to be maintained for segregation of raw material on which cenvat is admissible and material on which cenvat is not admissible..which was not being done in my case due to practical difficulty..being both raw materials i.e. on which cenvat avilable and not available were on same floor.i.e. export was being done from raw material on which we were not taking cenvat.now as per provisions nad rules of ccr i have to pay higher duty@6%..to save this any tax planning possible or how to satisfy assessing officer of this practical difficulty faced by us to save duty..

Q. EXEMPTED GOODS - Mr. Dev had puchase goods from manufacturer who charge excise duty on that. Aftr one month Mr. Dev acknowledged these goods are exempted and want to claim that money which is paid by him as a excise duty but manufacturer refused to pay.
