Q. Work Contract - Dear member, in my Company tax department is having practice to charge ST @ 6% as recipient and service provider is also charging ST @ 6% so in total we are paying ST 12% . Service provider shows service portion seprately and the rate is applied on service portion only but the confusion is that do we need to pay ST after abatement i.e 60% as it is for fitting of machinery and to apply 3.6% (12*60%*50%) as reverse chage applicable to us and without considering the option (Method) applied by Service provider. also clarify about Cenvat credit of ST paid to Service provider and as per reverse charge in case 1 and case 2. Q. Place of Provision of Service - Just want some clarification on the issue of Place of Provision of Service.
My client is providing inspection service in the state of Jammu, both my client and the service recipient is situated in Delhi state are the services liable to service tax.
Further, as per Law of J & K GST would be deducted @ 11.5% by the service receiver.
Please guide on this issue.
Would rule 4 apply or rule 8 apply

Q. Service tax - There is a religious trust which gets residential units (around 100 units) / kitchens / dining halls / toilets etc. constructed for the stay of its disciples / followers on the land owned by the trust, by hiring local contractors/builders. The contractors / builders are hired for the sole purpose of constructing the structures and are paid through cheques/cash. No land/building/structures are transferred to such contractors/builders. The residential units / kitchens / dining halls / toilets etc. so constructed are not intended to be sold or transferred to anyone & would remain the absolute property of the trust.

Would the trust be liable to pay service tax on the construction of the abovementioned structures? If yes, pls. state the relevant rule / clause which brings the above construction under the preview of service tax. If no, pls. state the reason.

Xyz got a contract to supply scaffolding material on a rental basis from MNR Co they also got another contract from the same company to supply manpower for the given job.Here both contracts are independent. Now, XYZ taken a material as well as manpower from ABC sub contractors.
Question No.1 For materials supply on rental basis whether sales tax or service applies.
